Defamation is defined in section 499 of Indian Penal Code 1860 and section 500 provides that a person committing an offense under this section is liable with simple imprisonment for a term of 2 years or fine or with both. If you found this helpful, please rate us.

he word Defamation means Abuse, Aspiration, Denigration, Depreciation, Publication etc. Ordinarily, the offence of defamation is stated to be made against a person or persons harming his/their reputation. The ingredients of defamation are- making or Publishing any imputation concerning any person, such imputation must have been made with the intention to harm with knowledge or having reason to believe that it will harm the reputation of the person concerned. Therefore, the intention to cause harm is the most essential sine qua non of an offence of defamation under section 499 of Indian Penal Code. If you a+can prove this, you can file a suit. A.If army officer is on duty and was discharging his official duty then no case is made out. Stating a fact is not a defamation.
