Hi Sirs, My neighbor is having a mango tree beside my house compound wall, in less than 1 feet gap. Because of this every day there is a lot of wastage from tree dropping on our grounds and making us to spend 30 minutes more every day. And also making my wall and floor plastings to breakages because of root dweelings below the ground. This tree is making two types of losses to us, Wall breakages and spoiling our 30 min time every day. We had informed and discussed with our neighbors. But they dont want to cut it or cut the branches. So we suggested them to lift the wastage of the tree from our grounds. They have not agreed for that also. Raised a complaint in the panchayat office. They are delaying it and don't know the reason. We want that tree to be lifted up with the roots to save my walls and floor along with 30 minutes' time. If they want to keep the tree then they should lift the wastage from our grounds. How to proceed here. Which is the best way to tackle this? Kindly help me.

A.Hi,
A suit can be filed against the neighbor under Indian Easements Act and under section 425 of the Indian Penal Code for harassment . Thank You

Your case comes under the ambit of Indian Easements Act. You can file a suit against your neighbor for the same. Thank You
