My husband filed for separation 7yrs back on the ground of adultery and mental harassment. Of course it was a false case. I fought the case for past 7 years. In between I had filed a 498A against him for harassment he and his family did to me.
Surprisingly after the 7 years of fighting the case, judge gave separation order just based on the 498A which is still going on saying that it shows cruelty. His allegations of adultury was rejected.
I have a 12 yrs old daughter and no one to support me in future. I had faught this case only to clear my name because he had put false allegations on me.
I would like to know what are the rights and benefits my daughter has and for which I can file petition for. I am really fed up with how the case drags in the court of law and the kind of money required to spend on it.
Please give me a word of advice to secure my child's future.
A.U can even go for divorce by mutual consent if your husband agrees.In this you can take permanent alimony and it will take only 6 months to decide from the date of first hearing in court called first motion.

A.You can either file a divorce petition and claim permanent alimony which means one time full and settlement amount for future of yourself and your daughter. But that will take time to be decided. If the court does not expedite the case, u can move high court for directions for time bound disposal of divorce petition.
In the meantime u can file 125 crpc petition for maintenance before the magistrate court.court will also direct for payment of interim maitainence till final decision of 125 crpc petition.
Or
You can file a domestic violence instead of maintainence case claiming damages, maintainence etc from your husband.in domestic violence case also court will direct for interim maintainence.
