Dear Sirs/ Madams, we are living in a village in the state of Andhra Pradesh. Recently we have a problem with our neighbors about a mango tree problem which is very much close to our wall and the root trunk in their land. This tree has caused so much nonsense with fallen leaves, other stuff, and it had broken our wall at two places. We have discussed this with the neighbor and he replied in a rude manner, then we have taken the issue to the Panchayati officer after that panchayat officer warned them they started bad talking on us(bad words). Along with this, they have started that we occupied their land other this tree would be in their land. But it is quiet wrong and a false statement. They have not argued or given a complaint in PS or court or panchayat for the last 17 years regarding the same.

As it is a village, no border neighbors have any registration for the land they are living, but we are living in the same area for more than 17 years for now. How to prove legally that it is my land? and how to proceed for the false allegations?

Kindly help me in this.

A.Hi,
Complain to the police about nuisance under Section 268 IPC. You can then get a Court order to have the tree removed citing safety concerns.
File a suit for declaration of title to have the Court determine who the lawful owners are. Your neighbor can be prosecuted for making false claims under Section 209 IPC.

A.Hi,
File a suit for declaration of title. You can then file a complaint for nuisance under Section 268 of the Indian Penal Code and get the tree removed by a Court order. Persons making false claims can be punished under Section 209.
