In our society there is vacant car parking space . The owner is staying abroad . So we enquired him about the parking space so that we can park our car there . He gave his consent over telephone . He has no problem in our parking as long as we pay the rent to the society . We have agreed to him that whenever he wants the parking we will vacate it . But the society
is objecting to this arrangement . They are insisting for a written consent from the owner which he is not willing to give . At this point we are forced to park our car outside the society premises as the society is opposing our parking in the above said slot . So what shall we do? . Is the society's stand legal ? Please advise .

A.Hi,
You can serve the society with legal notice to stop harassing you. Inform them of the owner's consent of the same. If he is unwilling to give written consent, they can have him declare the same verbally. As an apartment owner, you have the right to receive adequate parking space.

Serve the society with legal notice to stop harassing you. We can help you draft an agreement in such a way that the owner would not feel threatened about losing his parking space permanently.

A.If you are paying rent to the society regularly then the society had no right to stop u u are legally entitled to park inside .You can file complaint before police and can also send a legal notice to the society management .After this u can also file application before civil court for mandatory injuction (directing the society management )to allow u to park your car inside society.Rate me if u like my advise

A.As a caution based practice society is correct in its place as society parking is for society members and tenants do not become members of the society. However may be you can ask owner to provide through email in writing that you can use his parking in his absence and I believe the owner should not have any problem in doing so.
