A mother had a property (house) in her name constructed with the help of a bank loan. She had two major aged sons. The elder son assured orally to clear the pending portion of the loan amounting to 25 lakhs approximately provided the mother has to transfer the property in his name. Mother had transferred the property to the elder son without the younger son knowing anything. The elder son left the house with the property agreement registered in his name and its been more than a decade his whereabouts are untraceable. He has not even paid a single penny to clear the loan as agreed orally prior registration. Is it possible for the mother to cancel the registration and register back the property in her name? If so what is the procedure? This is for my client who is residing in the down south of Tamil Nadu.

A.Hi,
It is to add to your knowledge that If the transfer deed has not been executed yet, the property is your mother's only.
On her own desire, your mother can cancel the transfer deed and pay the loan on her own.

A.Hi,
If the transfer deed has not been executed yet, the property is your mother's only. Your mother can cancel the transfer deed and pay the loan on her own.
