My wife gave false DV. case against me and left my home with my 9yrs old daughter 6months ago and presently staying with her parents.after leaving my home she didn't allow my daughter to visit with me.i use to talk with my daughter over phone.last 1month my wife also stopped it.i love my daughter very much and can't stay without talking with her.i am paying all expenses of my daughter.now what to do so that I can talk or visit with my daughter as soon as possible.my wife is also saying that she will not allow my daughter to keep relation with me.

A.The child above the age of 9 yrs, are given choice for the custodial and visitation rights by the Court.

You can approach the court and file a petition for the visitation rights for your daughter.

paying for the maintenance of your daughter, that would strengthen your case for the custody of the child if she is less than 9 years but in this case her choice is most important.

A.You are required to approach court and file case claiming custody of child. As interim relief you can pray to meet your daughter on regular basis at regular intervals. Being father you are entitled to meet the child and also to have her custody.

A.Hi,
You can approach the court and file a petition for the visitation rights for your daughter. The child above the age of 9 yrs, are given choice, since, your daughter is above the age of 9 yrs, her choice would be considered for the custodial and visitation rights by the Court. If the mother is neglecting or ill treating the. Since, you are paying for the maintenance of your daughter, that would strengthen your case for the custody of the child

A.you have all right to take custody of your daughter as well as visiting right. ask a lawyer to file your case accordingly.

A.Hi,
You can approach the court and file a petition for the visitation rights for your daughter. Since, your daughter is above the age of 9 yrs, her choice would be considered for the custodial and visitation rights by the Court. If you could prove that the mother is neglecting or ill-treating the child, then it would be much more easier to get the custody. Since, you are paying for the maintenance of your daughter, that would strengthen your case for the custody of the child.
