Dear sir/mam,
Myself akrit with due concern want to ask a question.
My father has died in childhood and my mother has taken his job( post has been degraded). My father was 4 brothers. But my mother has a second marriage and my fathers name has been changed in all my certificates. Will it be possible to claim my inherited property on the basis of my mothers job as she has taken my fathers job. In certificate nowhere my father(1st ) name is mentioned.

A.You would have to produce your birth certificate and file a civil suit. But please check on limitation and get all documents relating to the property before you actually take any step

Thanks for response mam,
Actually even in birth certificate my original father's name is not mentioned. What can I do then? The only evidence that I have is my mother's name mentioned in every certificate. And I have even kundali with me in which his name is mentioned . Please reply how should I proceed or it will be just waste of time .

A.Yours is a complicated case as, after second marriage inheritance to late husband property there is a bar on remarriage, better to consult a professional lawyer for guidance & help on all aspects of the issue quickly.

A.your rights from your father's property can not be denied due to the change of name. File a civil suit for the property share in the civil court and claim your share. You may also challenge any ancestral property if transferred/sold after the death of your father.

I want to confirm just one thing that if I have no legal evidence of late father in any certificate. How will I able to prove that legally.? Thanks for reply Sir.

A.Your mother got compassionate appointment. That is not relevant to your father's property in any manner. If your father was in ownership of any property at the time of his death, you will be entitled to it. But I am unable to understand what you mean when you say "inherited property".

Dear mam,
Thanks for reply.It's self acquired property not my late father's personal property. Actually it's grandfather's property but my uncles are not giving my share in it. They are just psychologically pressurising and telling who is your father now? In this fight I am 28 they are trying to suppress me.
