Motor Accident

sec.166 of the MVAct,1988 , Case got disposed, IA Status Pending

My father met with accident in 2016, then due to injuries and resurgery he was unable to attend the court till mid 2017. Then he went to court whenever advocate called him. But,O.P got dismissed for non prosecution on 13-12-2018 due to continuous absent of petitioner. Actually we were unaware of the date of hearing as our advocate did not inform us even after the case got disposed.When we came to know she said we can reopen and applied for IA on 05-02-2019 it is still showing pending. In 2019 as we went she said due to summer vacation or judge retirement or some election issues its getting delayed. Know due corona its getting delayed till now. Can I trust our advocate or Are we being manipulated? What is IA? Is our case running? When will or case be cleared? Can we go to lok adalat ? Please let me know what to do ? Thankyou

Hi,
You should continue the suit in civil court only. Do not approach Lok Adalat since you have already initiated the proceeding in civil courts.

Hi,
If you don't trust your lawyer, you can hire another one. You should also keep the case in civil court rather than in Lok Adaalat. An interlocutory application is a request made by one party, asking the court to make orders to help with their case's preparation or procedure. Court proceedings rarely go smoothly, therefore interlocutory applications allow you to seek orders to help keep your case on track or protect your rights in some way.

You can trust your lawyer or you can go to court and figure it out yourself what is happening about the case. Check it for yourself if you are in doubt.
IA stands for Interlocutory Application which is filed in between when a case is going on.
Case will be cleared when the court will reopen after the lockdown your case will be heard.
Don't think you can go to lok adalat when the case is going on.
You can check the status of your case on ecourt and know what is happening.
