After my father's death, me, my mother and 2 brother live together. Now the land is in the name of my father and there is some empty space where i want to build a house and I have applied for a loan but until the land is in my name bank will not give me loan. So I want to know what is the process? how much time it will take etc.

A.If WILL is there then probate it.
If no WILL is there then everyone have share.
Go for partition suit.

A.Hey,
As per Hindu Succession act the property is transferred to legal heir incase there is no Will. So if there is no Will created by father you can file for partition and execute partition deed. Then land will be transferred to your name and you can file for loan from bank.

A.Hey,
If there is no Will created by your father then you can file for partition and by getting partition registered with the registrar which will act as proof of ownership and you can transfer the land in your name. And then apply for the loan.

A.You will have to get the land transferred in your name to get the loan. Since your father is no more so what you can do now is that you can get a succession certificate made in your name and all the legal heirs name made and then do a partition deed and get it registered. It can done in faster way depending on how fast you are able to manage things like drafting of docs and going to different offices and get the paper work done.
