My 1.25 bigha land has started coming under nagar palika, and other land owners around my land have started plotting/construction of their respective lands, but boundaries of my land are not clear and marked properly, I asked lekhpal to demarcate the land and he did it without any SDM orders, now the issue is there was a kaccha rasta though medh between my land and land beside me, which according to lekhpal comes under my land and is not there in map and registry, but people there are saying you cannot take that kachha rasta in your land and they do not agree to map/resgistry/lekhpal wordings, any of it. What should I do as legally measuring the land with procedure might take time and people having construction around my land would complete till then and my actual land would get reduced if I don't get that kacchha rasta later on which is although not there in map. Please guide.

A.Hi,
The best option you have is to first construct the boundary on the demarcated land. Also if you want to demarcate it with the order of SDM you must write a letter to the SDM or the district collector explaining your situation and request them to order to some one to demarcate your land. if that doesn't happen then construct the boundary on the already demarcated land done by the lekhpal. So that, you could claim compensation when from the nagarpalika if they ask you to leave the land for kacha rasta.

A.How long it has been in that state? If you want to claim any right over that piece of land you have to ensure that you have not given away that right for last 12 years. If so is the case you can file a declaration petition and also get your land demarcated by the court appointed surveyor. Make sure you make all the neighbours who object to your land a necessary party.

A.Hi
You must first demarcate the land and construct a boundary around your land, So that when the nagarpalika come and ask you the leave a portion of your land for the kacha rasta you can claim compensation for your land. Also write a letter to Concerned SDM explaining your situation and ask him to order lekhpal to demarcate the land and also to mark that kacha rasta .

A.In land matters the more you delay the more you will loose is the thumb rule. You must erect boundary demarcating your area so that later when govt. people come and ask you to leave the land for way "kachha rasta" you can seek compensation or else you shall not get anything in the long run as they might pass out some order saying that this much land has to be left. Safeguard your rights. Get a person AMEEN and do the measurement and put temporary demarcation if not permanent boundaries.
