Hi Sir / Madam,

I had purchased a investor flat 2 years ago and along with it I got a Parking slot allocated. I have parking allocation letter from the investor, however someone else is parking in my slot and he says that this slot belongs to the builder. That person doesnnot have any authorization for this. I complaint in society for this and at that time he said that he will arrange for a different parking slot from buillder for me. However after few months he is now not agreeing and says the same again that this belongs to builder.. Kindly advise what I can do in this case

A.Dear Sir,
You may get issue a legal notice and file a permanent injunction suit on the basis of the letter issued by the Investor and the recitals of your agreement and Sale Deed thus you can prevent such person to park his car on your allotted slot.

A.He is trying to bully you -simple. When you have the letter how come he is parking his car. Throw him out and his car. Sometime going legal does not work. Just tell politely that remove your car as you are going to paint your ceiling of your car parking area with black paint. And the day he parks his car, paint your ceiling and let black paint be splashed all over his car. Followed by that the day he takes his car out put all rubbish and debris of you home is your parking area.
He will understand what next to do.

A.Hi,
As per the agreement, builder is liable to provide you with a parking lot, since he has not provided you, then he has done deficiency of service, therefore you can file a consumer case against the builder in the consumer forum.

A.Hi,
You can raise this issue with the registrar of societies. Alternatively, you can file a consumer complaint against the builder for deficiency in service for non allotment of parking space.

A.Better solve this issue amicably. If required visit the builder and get a letter from the builder stating allocation of the parking space to you and no one can park in that place without your consent, though if other guy is unauthorized to park his car there you can ideally take a legal action against him for illegal parking by filing a case after issuing him a legal notice but your matter doesn't seem that big, hence try solve this matter with effective negotiation. Thank you.
