Compensation for Agriculture activities done
2 years ago
On inherited land (agriculture) my uncle is doing agriculture activities since 1975. I want to have control of land to myself and also want to have the compensation for the income from agricultural source. How can I calculate the compensation and how can I proof it legally?
A.Dear Sir,
You have to file partition suit and claim mense profits. Normally partition suits have to be filed within the 12 years but you must create a recent cause of action and file it.

A.Hi,
You are not entitled for any compensation as you did not raise any objections of those agricultural activities until this period. If you have a reasonable excuse, you can raise that in the court or otherwise, you are not entitled for compensation as there was an implied agreement between you and your uncle to carry out agricultural activities on your land. You can have control on your land by approaching the court.

A.Hi,
Since your uncle has been doing farming since many years without any objections, you can't plead for compensation as you impliedly permitted him to do it or otherwise law presumes so. You can approach the court for having control of your land by submitting required documents to prove that you are the real owner of the land.
