Road connectivity issue to my registered land
2 years ago
We have 2 acers land and east side government road is there..but in between these two 80 cents of conditional land assigned to some person..there is a small canal for water acess passing throgh this land ...previous land owners used to have this canal sides to reach our 2 acers land ....now this 80 cents conditional land assignee not allowing us to use this can for water and walk to reach my land..
There is no other way to reach my land as it is covered by other private properties...how we can get proper road clearance to reach my land.
Please suggest..
A.Dear Sir,
On the principle of easementary rights if you have no other alternative road to access your agricultural land then you will get civil rights to approach the Civil right and get suitable orders.

A.Hi,
You can plead for easement by necessity. An easement by necessity, as the name implies, is created by law out of necessity, instead of by an agreement between neighbors. It’s usually created when the only reasonable and practical access to the property is through another’s property and an implied agreement cannot be reached. Once there is a new way to access your property (for example, if a new road or path is created), that easement can be terminated.

A.Hi,
You can claim for easement on his property. An easement right gives a person license to use another person’s land for a specific purpose. You can approach the court and plead for the same.
