I bought a house and the check was not received due to the wrong documents of the house, but I was paying my EMI, now the builder has corrected the papers, got the check but the builder is asking me for the rent of the house, should I pay the rent of the house?

You need not pay the rent and you may threaten to approach consumer Court for settling the matter. Thus, you may avoid paying the rent of the house. In many cases the builders may collect such rents.

It would be suggested to check the agreement you entered with the builder and if there is mentioned that you are liable to pay rent in any event like this then you are liable to pay otherwise not. If you have not agreed upon any such rent then you are not liable to pay any amount.

It would be advised to ask the builder for what he is asking the rent. You have purchased a flat your are paying the emi the for what he asking the rent. If he is asking rent for any unreasonable reason then you are not laible to pay him any rent.

Your questions are little perplexing.
If you have bought a house, then you have definitely, registered it in your name or have made any sort of contract for the same.
And, if your cheque fails to be claimed then how will the builder transfer it into your name. And if everything is corrected then you can settle the same with your lawyer by a mutual discussion.
Now if you have already bought it why will you pay the rent.
If the house is transfered in your name, or you have made an agreement to settle the same for buying, there is no point in paying so.
Thank you

A.Dear Sir,
When the builder has already received the cheque then there is no point of paying him any rent for the house. You are not supposed to pay any sort of rent to the builder as it was his mistake for providing the wrong details. And you have bought the house or flat and already paying EMI for the said flat.
