Surrender of shop provided by municipal corporation
2 years ago
one of my uncles obtained a shop in an auction by Municipal corporation....somewhere 70 - 72 years ago. eventually my father was handling the shop and the shop act license was issued in my name. Due to some disputes with my younger brother, i left the shop to him. the license and income tax returns are still under my name.
Now my younger brother threating me to expel me from shop entirely. in this scenario, can i surrender back the shop to municipal corporation? or if i cancel the license, will new license be issued in my brother's name? Which department in municipal corporation i can visit to get original action papers / award?
You can surrender the same to the Municipal Corporation addressing a letter by registered post to the said corporation. There is no possibility of renewing the license or issuing new license in the name of your brother.

A.Hello Sir,
Neither you, your father and your brother are the true owner of that property as your uncle has got the shop through auction. To get the shop license you should have the actual paper of that shop or power of attorney. On the basis of those documents you could get the license. It would be advised to visit the municipal corporation of your jurisdiction and get the detailed information in respect of obtaining the license.
Hello sir the person purchased the property in auction is the true owner of that property and only he could get the liscense until n unless he gave the property to someone else on rent or has written power of attorney for someone else. also you cannot surrender back the shop to the municipal corporation. Although if you have legal documents of that Shop then you could get a new liscense in your name.
Thanks
