A.property is bundle of legal right and all legal heirs are having legal share into said property . the daughter and mentally challenged person will get equal share and being the guardian of the mentally challenged person mother will take the responsibility of that piece and parcel of that property vested upon the mentally challenged person too. But, she cannot sell such property of the mentally challenged person's share without court's consent.so there is benefit for protection of share of mentally challenged person.

A.In the instant case it is evident that in the said property as left by deceased his widow, mentally ill son and daughter are legally entitled to get equal share therein so far share of the mentally ill son is concerned specially on those circumstances when his treatment is necessary to protect his life urgently and there is means is available except to the said properties belonging to said mentally ill son in such situation the mother of the mentally ill son being his natural guardian, well wishers and next friend have every legal right to sell the property of her mentally ill son to protect his life without taking any permission of the court under such legal necessity
