I have purchased a flat in Pune (PMRDA). I have two cars therefore as a precondition to purchase of flat I had mentioned to the builder that I will require 2 parking slots (stilts). I had to purchase the additional parking slot.He's now allotted to me two parking slots one behind the other. There is a wall ahead of the front parking slot.

Society is not formed as yet. But the builder wants to form the society.

Other members claim that all flat owners should be allotted only one parking slot and not two as in my case, since there is scarcity of 2 wheeler parking. Everyone should get equal allotment of parking space.

Builder will be issuing allotment letters soon where he will mention two parking slot allotments to me and is also going to register the conveyance deed for the society. He claims that parking allotments will be part of the registered conveyance deed.

Can the society committee once formed overrule the builders allotment and take away my second parking slot even after the conveyance deed is approved?

If they overrule the builders allotment post society formation, can I take legal action against society committee?

A.I agreed with hon'ble kalaskar. If you want to protect your interest then why don't you make proper discussion with society and clarify them all facts.

A.Dear Sir,

Impress upon the builder that while framing by-laws of the society and resolution of the society must contain a clause that the builders can sell more than car parking space thus you can protect your interest.
