if your husband does not appear in court for 3 consecutives dates after service of summons, court can grant you ex parte divorce decree in your favour after considering evidence on record. Where an ex parte divorce decree is passed the normal wait is 90 days for filing appeal or revision in the high court or apply to the Court which has passed such decree to set aside the ex parte decree.

If no appeal or revision or set aside application is filed by the husband within these 90 days from the date of passing the exparte decree, you will be eligible for marrying another man.

A.The court has discretionary powers either to proceed with the case on his or her absence, if at all the court feels to give one more chance for the person to appear before the court and counter his case, then the court shall permit sending private notice apart from fresh summons through court and post.
