Can we cancel registered land? My maternal grandmother died in 2021 april.she has one acre land in her name which costs around 1crore 50 lakhs. My grandmother has 3 sons and 1 daughter..sons registered that land in their name without even daughter signature. How can cancel registered land?

A.Dear Sir,
The daughter has to file a suit for partition and further claim to declare such deed as null and void and not binding upon her thus the said deed automatically cancelled.

A.After death of your maternal grandmother without making and publishing any Will, that property has been devolved upon her four children, each having undivided one-fourth share in that property and on the basis of Legal Heir Certificate, their names are required to be mutated in the Record of Rights in the place and stead of the deceased grandmother. It has not been specified who has executed registered Transfer Deed in favour of those sons. To give opinion, it is necessary to know the relevant facts in respect of that Registered Deed.

A.Dear Client,

To cancel the land registration document you need to file a suit for cancellation in the Civil Court. However, the discretion to cancel it or not is with the court. The court needs to be satisfied of the illegality in the document. It cannot be cancelled only on your opinion.

In this case what you can do is challenge the registration which was done without taking the other legal heirs into consideration. You can file a case in the court with the help of a expert civil lawyer and challenge this appropriately.
