Our Land in Chennai was notified for acquisition under NHAI road expansion in 2005. There is no communication after that notification. Now they are coming for demolition under encroachment. Now, they are showing that the order was passed in 2006 and the value is fixed as Rs 27 / Sqft. They are asking to collect that amount and vacate the land. There was no communication on this regard till date. What action should be taken. Can we go for value enhancement.

Current market value is Rs 3500 per Sqft and guideline value is Rs 1700. Market value in 2005 was Rs 250 per Sqft.

A.Dear Client,
file a lawsuit for injunction to either stop or restrict the encroachment. Later appeal to the court seeking better compensation for the land. That is usually calculated on the present value of the land.

A.Dear Client
You need to object the acquisition by sending a representation to the land acquisition officer who in tern will guide you to go to the correct forum or court. Once you have challenged that then you can also ask for the right value to be provided.
