A widow & childless women owing a property, as she's not having any dependent family, she wrote (settlement) that property for her relative grandchild. But after some years she attained natural death. Unfortunately the document was not yet registered, this happened before 30 years. After some time this land made as no man land (Public property). Area peoples are using this land for public uses as planned to built library & toilet. But now nearby house owner tries to acquire the property by illegal norms. Now the Grandchild is grown and settled in outer state, now he is ready to acquire legally & it will be handover to Public uses. What are the possibility to take action legally, by registering the property, as he is got settled for work in other state at the time widow women death.

As per the facts which have been provided, the grandchild can file a case in the court for claiming the property.

Hope this clarifies your query and requirement.

Thank you.

A.As that document was not registered so that did not give ownership right to that grandchild but it is necessary to scrutinize whether by Laws of Devolution, he can claim his inheritance right thereon by Legal Heir Declaration or not.

A.Dear Client
The person has to take legal course to reclaim the property and for that he will need to knock the doors of the justice that is the court. He can start with filing a suit for injunction against the public department and the neighbour and then file a declaration suit for himslef.
