my son expired last year in his house. He was unmarried. Can I claim his house & how?

However, if your son is Hindu, then the property will be distributed according to Section 13 of the Hindu Succession Act. If he is the only son and dies without making a will, then the property will be distributed equally among his parents, if he has siblings then the property will be distributed equally among his parents and siblings.

A.After the death of your bachelor son without making and publishing any Will, if he was governed by Hindu Law of Succession, then his house property has been devolved upon his mother and through Legal Heir Declaration her name is required to be substituted in the place and stead of her deceased son in the Record of Rights.
