I have given 1 Lac rupess in Dec 2020 @ 3 % p.m interest through bank transfer and he promise me to return my money within two months. In the begining he paid me interest on monthly basis through bank transfer till June 2021. He stoped pay interest afterward. In the month on August he issued a cheque of 1 Lac rupees with date on it. But due to family presure i did not present cheque in the bank and that cheque has be expired. after too many phone calls and msg he couried me a cheque amount 1 Lac and my name but no date on it. He sent 25000 in month of Jan 2022 as a previous (balance) interest through bank transfer. Now he neither he pick my phone nor reply on Whatsup.

1. Can i put date on cheque and issue in the bank ?
2. Can he fail a case on me as per the Money Lenders Act as its a punishable offence to lend money for commercial gain without a license.

A.Dear Sir,
You can put date on the cheque and file a cheque bounce case. Since because you are not running any regular money lending business as such no case can be made out under the provisions of Money Lenders Act.

A.Dear client, you can put date on the given cheque and present it to your banker. Further he might file a complaint on your name under money lenders Act until and unless you show some kind of relation to him either as a friend or a family.
