Sir, the parents have two children, one son and daughter, both are married, daughter has devoted twice and live separate from third husband, she and their parents dont want that she lives with her husband but son wants to send to her husband, she (daughter) forced to parents for sharing (divide) the property two parts, but son doesnt want to divide the property, she even forcing her parents to sell the property, one more son and daughter both dont want to live in one home due to family problems. Can their parents sell property? And is daughter has rights on their parents property?
A.Dear client, as per the hindu Succession Act, both son and daughter have equal right over the property. Hence she can get haft of her parents property.
