My father had transferred his assets, house and some property completely to my brother, denying all my rightful inheritance of a part of it just because I am daughter who is already married. How can I legally handle this situation and what rights can I have on a house that has already been cashed out?
A.Dear client in this case there are two situation. Suppose the property of your father are self acquired then you cannot challenge the same. However if the property was ancestral property then you can challenge this tranfer. Since after 2005 amendment to hide Succession Act, a woman is also the rightful owner of fathers ancestral property.
