I want justice

I want to know my child status ..because he born to my affectionate but I married another person due to my parents pressure.. But I told to this matter to husband. That time onwards we are living separate ways.. After 7 years my affectonated person marry the another woman.. Tell me sir what is my position and my child position

Dear client is your problem solved. If u do not want litigation and your husband has deserted you and raising no objection then u may marry the first Lover and father of your son. But if the married husband afterwards opposes it only then it will create problem.

Supreme Court has now ruled that marriage has nothing to do with childbirth, and recognizes single mother to be the guardian of the child. The ruling made explicit recognition of a woman’s fundamental Right to Privacy and withdrew mandatory requirement of father’s name on birth certificate, passport and school paperwork.

Facts not clear. You did not mention whose name is mentioned in the birth certificate of your child. If your husband's name has been mentioned as father in the birth certificate then your child's father is your husband unless your husband goes for DNA parental test and refuse to accept your child as his own through court's proceeding. Whatever be the situation, so long your child is not declared illegitimate child of your lover, the child will be officially the child of your husband. However, your husband can annul his marriage as null and void under the marriage law on this ground and both you and your child are not eligible for maintenance from him. What will be the fate of the child??? Hope your lover can say

Your child is the illegitimate child of your first lover.( whatever name you to him). He is bound to pay for his child`s maintenance, and the child is entitled to use your lover`s name as its father. You say you are living separately from your husband, but may not ahve taken divorce, anyway he is not legally having any obligation for your said child.
