My father's mental health is not stable. He drinks alcohol too much due to this he is not able to recognise what is good and what is bad. He can sell our ancestral property for money to drink. I am his son and want to take a temporary stay order untill his health condition becomes better. Can and should i take take stay order against my father.

A.In my humble suggestion, since your father has actually not taken any step to sell the property so it would not be of any use to file for an injunction order.

A.Dear Client
One takes stay order against an act or performance of an act which is happening presently. What yo should seek is the injunction to sell the property by your father but then how will you prove to the court that he is not eligible or capable to sell.
You can give it a try by filing an application for injuction.
