My mother has 3 sibling sisters and 2 brothers. And her father had given 1 home to elder son and 1 to yonger son in thier names when he was alive. But the elder son who is married it's been 20years that they have no child. My mother have no property and still we are living in a rented house. Can my mother raise a case against that elder brother for giving something to us from that property anyhow they dont have childrens .

A.In my humble suggestion, the issue could be resolved through a partition deed. Partition occurs in a partition deed when the co-owners agree to it. The partition deed must be signed on stamp paper and sent to the sub-office registrar's for registration.

A.Dear Sir,
You may settle the matter by approaching Civil Court by filing partition suit thereafter you may enter into mutual consent and end the matter by way of compromise.
