Hello sir ,
Did Agreement to sale but sale deed was not done as owner did not show up.I paid in cash so except for the Agreement to sale document no proof .Since it's also a legal document ,please help whetehr it can be challenged in court .It was my hard earned money ,the owner also had loan on the land which he did not disclose at the time of Agreement

A.In my humble suggestions, with the chain of fact, you can file a suit for the execution of the sale deed before a civil court. The court shall witnesses and decide on the validity of the sale agreement and pass a judgement as per the merit.

A.Dear Sir,

You have to file a suit for specific performance and a direction will be given to the vendor to receive the balance amount and execute the sale deed in your favor and to deliver possession of the property in your favor.

A.If you have agreement for sale then the payment schedule must be mentioned there in the same... The said agreement for sale must be signed by you and the developer along with two witnesses for its legal validity. When you paid the developer in cash, it was his duty also as well as your duty also to collect the money receipt upon paying any sum of amount against the said property. If the developer still refuses to sell you the said property then you can file a consumer complaint case before the consumer forum against the developer.
