My lawyer somehow managed to get Ex Parte judgement from court in my favour against my wife. I don't think the court notice reached my wife ever and obviously she was not present for any hearing. I understand that she has the right to appeal in the court against this judgement.
What is the validity of Ex Parte judgement?
Can my wife defy Ex parte judgement
Can I remarry? What would be the status of my second marriage in the eyes of the court?

A.Hi,
article 164 applies to an application by a defendant for an order to set aside a decree passed ex parte. The 30 days' period of limitation prescribed for such an application commences from the date of the decree or where the summons was not duly served, when the applicant had knowledge of the decree.

Please be informed that your Ex parte divorce is a valid divorce and , today your ex wife can not ask for a mutual divorce. Please note a case that has been decided to finality by any court can not be raised again in any other court.
