PROPERTY DISPUTE AMONGST BROTHERS
WE HAVE A HOUSE PURCHASED BY OUR LATE FATHER. WE ARE SIX SONS. NOW THE PROPERTY IS ACQUIRED MOSTLY (80%) BY ELDER ONE AND BALANCE 20 % BY YOUNGEST BUT ONE. THEY DON'T ALLOW TO ENTER THE REMAINING BROTHERS TO THAT PROPERTY. I AM THE THIRD BROTHER. THE PROPERTY HAS TO BE SOLD FOR DISTRIBUTING THE VALUE TO BE DISTRIBUTED AMONGST SIX BROTHERS. THE MEDIATION IS NOT A SUCCESS. WHICH COURT IS THE COMPETENT AND FAST COURT TO DISPOSE THE COURT. WHAT IS THE APPROX TIME REQUIRED TO RESOLVE THE CASE ?
A.Dear Client
Depending on the location and valuation of the property the jurisdiction of the court is decided. Mostly these kinds of cases are filed with Civil court either senior division or junior division depending on the value as I said.
It is very difficult for someone to say that what time will be taken to resolve the case meaning getting the judgement in the case. One can only generalize and speculate here and if all the parties to the case cooperate then the case should be over between 2-3 years.
