We have an apartment with 130 flats. While the MC has taken over the management of the apartment 10 years back, the builder hasn't given clear calculation of the UDS tallying to the total area and also want to give a portion of the clubhouse to 3rd party with access to the parking. The handover documents are pending due to these issues. Please advise what can be done?

A.Dear Client
What your builder has done and is doing appears to be malafide and is going to impact the legal rights of all other residents of the complex. The MC should set up a meeting with the builder to sort the issues and if required legal recourse can be taken depending on the outcome. Also on the issue of selling the portion of the clubhouse to a third party MC can go for obtaining a restraining order from the court.

Thank you sir for your advice. We have had multiple rounds of talking and basis private survey, there seem to be deficit in total land area mentioned in the deed vs. actual. Builder wants to handover whatever docs he has and wants us to sign that there is no dispute/outstanding which we have been referring to. Few mentioned that since its very late, we shall take control of documents as is basis and then follow legal case. Its chicken and egg for us.
