can husband alone file a case against wife ancestral property without wife willingness ?
Hi Sir,
My wife parents had ancestral properties such as agricultural land and they died after our marriage. After their dismissal all of properties transferred to her brother name without giving any share to my wife. She willingly transfered to her brother and she doesn't want any share from her parents assets.
Now my question is can husband alone file a case against this property without wife willingness ?
A.Dear Client
In this scenario only the wife is the legal heir of the deceased parents and not you. If the wife being the legal heir has denounced the property then you being her husband will not be legally allowed to contest and get a share out of it.
