last year Oct 2021 , we decide to buy farm land with small house in that land from relative (both party belong to Aadivasi ST category) till now Agreement to Sale is done till now we had given all money to that seller( relative) as it need to show in sale deed as per told by tashil office but he suddenly given that house to someone else without any prior paper work and also taken money from that man (A). A person had already destroyed that house i had register NC in local police station against A . not any strict action taken yet what to do next ? i can't even file complaint against that seller (relative ) if i file complaint he might not sale land to me and as for money i already got to know he don't have any money to return me which i have given ? i am really helpless please give me advice.
You have to file a civil suit praying for a declaration for cancellation of the 2nd deed as alleged to be registered by the 3rd party. You can take criminal action also for cheating under IPC.
You may not get answer or solution in the Civil Court or in Police Station. Better go to higher police officers or High Court.
