We are ground floor owner and there is water leakage in first floor bathroom floor and its damaging ground floor ceiling. Even after repeated follow ups, first floor owner is not fixing it. How can this be resolved?
A.Dear Client,
The act of causing damage to your ceiling wall accounts to nuisance and your neighbor is responsible to get the fix the problem of water leakage. You can explain your grievance to your neighbor and try to resolve the matter amicably. If your neighbor does not rectify it, you can send them a legal notice. If they fail to repair it, then you can file a complaint to the local police for the act of nuisance and also file a suit before the jurisdictional civil court and seek an injunction to repair the water pipe and claim compensation for the damages caused. If required, you can consult an advocate for advice and assistance.
Hope it helps.
Thank you.

A.Dear Client,
If there exists a registered Society in the housing complex, then you should bring the matter to the notice of the concerned Society. In case the matter is not resolved or no society exists, then serving a legal notice to the upstairs neighbor, lodge an FIR/complaint to the nearest police station for public nuisance under Sec.268 of IPC. Reach out to an Advocate for guidance and steps.
