hello my marriage going on 5yrs ago and I have 1child he is 2yr but after marriage startings I'm not happy and mentally depressed and feeling tied and alone because of my husband not support and respect me and not going to me outside with him and not alone and my choice my dream no value for him he is not given time to me come to late at night and drink daily but I am try to live with him but because her parent but he is not understand and listen to me I have only with him my child but I have decide to quit him but he is not give me mutual divorce but I am not love him and not feel him because he is tortured me mentally then I have not feel him please suggest me

A.Dear client kindly File a divorce petition on the grounds of cruelty
Also file a petition under Domestic Violence Act
And also file case for maintenance

A.If he is a habitual drunker then lodge a complaint with the local police station for domestic violence and 498A against him that he beats you after getting drunk. Thereafter file a divorce case on the ground of cruelty. You are entitled to get the custody of your 2 years old child along with maintenance for both. Alternatively if both of you have decided to end this marriage, then you both can get your marriage dissolved by filing an application for mutual consent divorce which takes six months.

A.Dear Madam,
You can file DV case with followi9ng prayers then you can file Divorce case. It may end in mutual divorce.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
A) to take cognizance for the offence punishable u/s 498A IPC and punish Respondent No.1 to 3 as per law and extend police protection to the deponent,

B) Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.

C) Pass orders u/s 18, in totality against Respondent No.1 to 3,

D) Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.

E) Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent No.1 as he is residing in the house of respondent No. 3, which is legally prohibited,

F) Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent No.1 falsely filed Divorce Petition.

G) The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,

H) That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.
