My father died in 2001 leaving behind a wife, a son and 4 daughters. After his death there was a Partition Deed (VATANI PARTA) stating all our names ( 6 people). My 3 elder sisters wanted more share so, they went to court and there is a property dispute case since last 20 years. My brother who was the youngest of all, and died in 2015 in an accident, who was not married at that time.
What I want to know is will the property still be divided in 6 parts as his name was in the Partition Deed and will my mother get his part as per the law?

A.Hello Client,
According to the Hindu Succession Act, if the person dies without a wife or children, then his share of the property will be given to his mother and in this case, his share of the property will be transferred to the mother.
