We are small apartment group of 6 owners, we have not formed any legal association for the flats but we have mutually aligned b/w all owners to collect the maintenance charges and very open in the expenses being made and we take rounds for every 2 yrs for incharge for the maintenance activity . also we take mutual support whenever required and share the responsibility.

But there is portion of property owned by a person who leased out the apartment to an agent who in tern leased to a tenant . looks some issue went b/w 3 parties and the agent looks to be abscond. so legal issue b/w the tenant and owner is heared to be ongoing for few months now. all these months the tenant were paying out the maintenance charges stopped for last 6months +.
Never the owner take responsibility nor the tenant.

But we ( the other owners) have been handling all the maintenance activity so far is finding difficult to approach as we dont get a proper response from both.

How this issue shall be addressed and resolution can be achieved? kindly advise expertise opinion.

A.Hello Client,
In India, oral contracts are also accepted so if you do not have any documentation for your agreement then you can still prove that there was a contract and according to the same, the owner will help liable for the maintenance fees. Please consult an advocate as well. Hope this helps.
