Hello Sir/ Madam, My Mother (58yrs) has three brothers and all are in good terms. But my grandfather sold 7 acres of agricultural land after the demise of my GrandMother in their native Town that was supposedly kept for my Mother . The sale has happened 14 years back with all the 3 signatures of my Uncles (my mother's brothers), but not my Mothers. There is no signature of my Mother or Father. Now my GrandFather is feeling very bad as he couldn't give my Mother her rightful property, whereas all my Uncles got their share of property. My grandfather is thinking of filing a petition but again we are afraid where he and my uncles will fall into trouble as my GrandFather is 87 years old. Please help us here to know if there is any chance for my Mother to claim this property, if so how to move forward without creating a trouble for my GrandFather and Uncles. Thank you very much in advance.

A.Dear client if current owner did all transactions fair legally with legal consideration then you cannot oppose. Even your objection limitations is over.

A.Dear client Limitation is over , so u can not file a suit. The man who purchased the property has paid consideration at the time of sale so he is b legal owner. Court will protect his rights. Do u want to deceive others making misuse of Law ?
Dear client forget it. Done is done and it can not be undone.

A.Dear Client,
The basic principle is the origin/source of the property.If it is ancestral property then your mother has a equal share.
Get in touch with a Civil Lawyer through Vidhikarya.com with all relevant land records including the EC for last at least 65 or 70 years ( from the Government Land Record office) which will show the original owner and source from which the land has been procured and by whom and also method and when. That would help you a lot.

A.whether the property is the self acquired property of your grand father or ancestral property that is to say that property was inherited from the forefathers of your grand father. If it is the property of your grand father`s forefathers then you mother has one equal share with her brothers and father. If it the property of your grand father i.e., his self acquired property then your mother has no right in it till the life time of your grand father. Even in his life time he disposed of his property and your mother has no right to share in the property of your grand father.

A.Dear Sir,
If it is ancestral property then it is ok. Otherwise your grandfather must come forward to file the suit for cancellation but limitation is over. It is a very weak case.
