I don't want divorce from my husband, I have filed restitution of conjugal rights case but he has filed divorce case. 4 year of my marriage is running, there is no child. Marriage has been performed under hindu marriage act. As he has broken the marriage so I am living with my parents for more than last three years. As I am interested to continue the marriage so can he get divorce from court ?

A.Hello Client,
if your husband files for divorce and you do not want to, then you can fight the case and provide evidence in order to convince the judge. Hope this helps.

A.Dear Sir,
Both the cases will be clubbed together since issues are contrary to each other as such common evidence will be recorded. You have to produce your evidence and your husband will produce his evidence thus you may get judgment in your favour.
