Sir my ancestral property is registered on my Father's and his elder brother, without properly distribution between both. Now the Uncle has tried to sell the property without even alerting us. And took 4lakh as advance. And the buyer who gave 4lakh now started capturing the land. The jurisdiction is under Kolkata H.C, and North 24 paragana district. We don't want to sell that area to any third person and want to buy the would be divided area of his. I reside in Assam. If anyone can help me out that would be great. Thank you in advance.

A.Hello Sir,
You can ask your uncle to sell you the land and you will pay if the required amount. As the property is also not properly divide you can demand for the Partion of the land properly so that you guys can get know which part of the property you have.
