Wife not returning home, what can I do

My wife gone her parents home after 1st baby delivery in 2021, her parents not send them for 9months due to their relatives daughter left home with lover, during that period we tried 3times but her abused my parents and send them back, after 9 months send her back,. Now in 2023 again my gone wife gone to her parents house for sankranti festival, now again they refused send her back,. Please suggest me is it beneficial to filing police case against her parents for kidnapping my wife and son, or else I can do in this case

U can file RCR at Family court to get your wife back. But before stepping into seeking legal remedy get your elders from your family and have a healthy discussion, if the same fails then as a last resort u can seek legal aid.

File a case in the court Under Section 9 of the Hindu Marriage Act, 1955 which states restitution of conjugal rights.
The purpose of restitution of conjugal rights is that the Court should intervene in a matter and because one party may have deserted the other, direct it to join the company of the spouse. It is obvious that such an order is to be passed so that the matrimonial home is saved and the married couple can live together.
