Hi,
I purchased a flat in Bangalore with a total 154 flats in the apartment. Builder got our association registered under the Karnataka apartment ownership act, 1972. However, during the society election, builder nominated itself as the custodian of proxy votes and out of 75 votes, buider had proxy forms of 29 votes. Also the residents, who later became the association member, had about 10-12 proxy votes with them. With all the proxy votes, they came to power.
As they formed the association, they agreed for a humongous maintenance charge of about 5Rs per sft for a property size of 2acre.
Post-forming the association, they are not answering to any of my questions related to the financials of the association, the bye-law states that association is supposed to keep the record of accounts and can present the audited financial statement during AGM.
Our maintenance is based on open book basis but they are not allowing us to look at that document also.
My question, is there any way by which they can be forced to provide with the answers?
Since they are not providing me with the details, will it be legal if I also stop maintenance fee?

A.you can either approach the Secretary of the Housing Board or RERA Karnataka to redressal of your grievances. If they don't take appropriate measures, then file a writ petition in the high court for appropriate order(s) on the concerned authorities.
