I am a married woman and have a property dispute with my family which is currently being held by Delhi high court for last 12 years. Now my family wants to compromise and we are on same page finally.
But next high court date is for August. How can i prepone that date to end of this month or May 1st week and withdraw the case on grounds that out of court settlement is being done. I am petetioner in this case.
A.Dear Client
If all parties agree to settle out of court, you can file a joint compromise petition or consent decree with the court, which would request the court to dispose of the case based on the terms of the agreement. Ultimately, the decision to pre-pone the court date and withdraw the case rests with the court, so it's best to seek the advice of your lawyer.
