Construction of rooms on 2nd floor terrace legal or illegal Construction of rooms on 2nd floor terrace legal or illegal

Our building is in East Delhi and has 3 floors with each floor being occupied by different family. Now, 2nd floor is building 2 rooms, modular kitchen and bathrooms on its terrace without any plan being sanctioned by MCD.
1) Is it legal to build rooms without plan being sanctioned by MCD
2) Is there any type of construction (kacha Pakka) which can be done without taking permission from MCD

A.Hello,
As per the information you have given it is suggested to you that according to the law, it is illegal to construct or re-construct or make addition/alterations in any building without obtaining a separate building permit for each such building from the Authority.
