We have property, which brought way back as joint owners with the name of my Mother and my Mother's brother. The property is on my mother's and my moms Brothers wife name, my mom is pass away two year back , we try to transfer my mom property to our name, but my Mami is not agree for the same, what are the our options ?

A.Dear Sir,
You have to get issue legal notice and then go to Civil Court and thus you may get 50% of such property in your name. It may take some time. In the mean while try to get possession of the property.

A.Dear Client,

If one of the co-owners dies, their share in the property does not pass to the other co-owners but to the person named in the will of the deceased. The inheritor becomes a tenant-in-common with the other surviving co-owners.

Since you are the living legal heir, you have the right to inherit your mother's share in the property and your mami cannot forbid you from doing so. Proceed with taking legal or arbitrary action as required.
