Non Occupancy Charge in SURAT,GUJARAT

I have given my 3BHK flat on rent in Surat, Gujarat.
The society is charging me a maintenence of 25% extra than what others are paying as Non Occupancy Charge. This is totally unjust and unfair.
On top of the 25% they are also charging me interest on the same year on year.
I have written a letter to the society that , this is unjust and illegal. Still there is no response from their end.
What is the next step? How to follow about it next.
P.S I am aware of the 10% cap on the NOC Charge as per the Section 79A of the Maharashtra Cooperative Societies Act, 1960 .
