Phone taken away by college

I was giving my sem 6 examination and forgot my phone under my desk. In the last 10 mins of the examination the teacher saw the phone and took it away and said I was copying. I had no idea of the phone being under my desk as I thought that i kept it inside my bag and left it outside. I presented this case in front of the exam committee and they did not believe me and gave me kt in that subject. They are also refusing to give my phone back , is there any legal action I can take to get my phone back?

A.Any kind mobile phone, calculator or any other gadget that may be misused by a student in course of an examination is not allowed inside the exam hall by the educational institute to prevent any malpractice.
It appears from your version that you failed to prove your honesty before exam committee and accordingly they kept it with them to verify your explanation from the contents of your mobile.
In case you reported the matter to the police to get back the phone you should also make you ready to face all the consequences arising out of police investigation for breaking a prohibitory mandate of the institution by leaving your phone inside the exam hall and already failed to prove your honesty.

the act of yours on part of school is illegal. school cannot retain the mobile and is bound to return. you can file complaint with police against erring teacher and school administration. you are entitled to phone.
