we are four of them in my family ,we stay in village , my self- I am female ,my younger sister and mother and father, so when i was one year old my father thought that we are staying in village, may be my daughter will not have education properly here ,he thought like that and he sent me to my fathers younger sisters house(my mother-in-law) they stay in town , so,from that time till now I am staying with my mother-in-law only ,now i am 22 years old ,my father passed away 12 years back , my father is having 8.50 acres of land , so now i asked my mother even i wanted to marry , i am a major now please divide the land into three parts ,one part is for my younger sister, second part for me , and the third part for u till u die and also i said after your death your property has be divided into 2 parts one is for me and second one for my younger sister , so my mother is like we will not give single acre also and one more thing is here my younger sister got married 3 years ago and and my mother what she did is my fathers whole property sold to my brother in law (who is my sisters husband ) without my consent and knowledge , now what can i do to get my property back ,and also they are threatening me like do what ever you want we will not give you single acre also ,tell me the solution

A.Hello,
As per the information you have given it is advisable to you to file suit for partition of the property as you are also a coparcner under succession act, you are also entiltled to get your share.
You can raech out to an advocate for first hand information and he will help you out for fiiling the partition suit.

A.Dear Client

In case the property left by your father is intestate i.e, without a registered Will, all the surviving legal heirs of the family are entitled to an equal share in the said property and nobody can transfer the other's share in the property to anybody without the NOC of the said legal heirs. So the action of your mother is void from the beginning and challengable before the Court of Law. Reach out to an Advocate for guidance and necessary steps.
